Possibilit\u00e9s d\u2019expulsion et d’\u00e9loignement renforc\u00e9es du territoire fran\u00e7ais<\/h3>\n

Le projet de loi assouplit la protection quasi absolue contre l’expulsion dont b\u00e9n\u00e9ficient certains \u00e9trangers condamn\u00e9s pr\u00e9sents depuis longtemps en France ou qui y ont des attaches personnelles et familiales (par exemple parent d’un enfant fran\u00e7ais ou \u00e9tranger entr\u00e9 en France avant ses 13 ans). Ces \u00e9trangers peuvent aujourd’hui \u00eatre expuls\u00e9s en cas de terrorisme, d\u2019atteinte aux int\u00e9r\u00eats fondamentaux de l\u2019\u00c9tat ou de provocation \u00e0 la haine ou \u00e0 la discrimination. \u00c0 l’avenir, ils pourront l’\u00eatre aussi en cas de condamnation d\u00e9finitive pour un crime ou un d\u00e9lit puni de dix ans ou plus de prison ou de cinq ans en r\u00e9it\u00e9ration (par exemple pour meurtre ou viol). De la m\u00eame mani\u00e8re, le texte facilite le prononc\u00e9 par les juges de la peine compl\u00e9mentaire d’interdiction du territoire fran\u00e7ais (crime ou d\u00e9lit puni de plus de dix ans de prison, violences graves contre les forces de l’ordre…).<\/p>\n

Le texte r\u00e9duit \u00e9galement les protections contre les d\u00e9cisions d’obligation de quitter le territoire fran\u00e7ais (OQTF) en cas de menace grave pour l\u2019ordre public, m\u00eame lorsque les \u00e9trangers concern\u00e9s ont des attaches en France (par exemple \u00e9tranger r\u00e9sidant r\u00e9guli\u00e8rement depuis plus de 20 ans ou \u00e9tranger conjoint de Fran\u00e7ais depuis plus de trois ans).<\/p>\n

Ce qui concerne pour les mineurs \u00e9trangers de moins de 16 ans<\/h3>\n

L’interdiction du placement en centre de r\u00e9tention administrative (CRA) des mineurs \u00e9trangers de moins de 16 ans est pos\u00e9e, y compris lorsqu’ils accompagnent des adultes. Le gouvernement traduit sur le sujet la jurisprudence de la Cour europ\u00e9enne des droits de l’homme (CEDH). En revanche, les conditions de r\u00e9tention des \u00e9trangers mineurs de 16 \u00e0 18 ans n’\u00e9voluent pas. Ces derniers pourront toujours \u00eatre plac\u00e9s en CRA d\u00e8s lors qu\u2019ils sont accompagn\u00e9s d\u2019un \u00e9tranger majeur.<\/p>\n

Renforcement des mesures pour lutter contre l\u2019immigration irr\u00e9guli\u00e8re<\/h3>\n

D’autres mesures pour lutter contre l’immigration irr\u00e9guli\u00e8re compl\u00e8tent le texte : aggravation de la r\u00e9pression contre les passeurs et les \u00ab\u00a0marchands de sommeil\u00a0\u00bb, autorisation du recours \u00e0 la contrainte pour le relev\u00e9 des empreintes digitales des demandeurs d\u2019asile \u00e0 la fronti\u00e8re, contr\u00f4le visuel possible par la police aux fronti\u00e8res des voitures de particuliers en \u00ab\u00a0zone-fronti\u00e8re\u00a0\u00bb (et non plus seulement des v\u00e9hicules de plus de neuf places)…<\/p>\n
